These entities and their works are protected by copyright and trademark laws in the US and abroad. We intend to respect these laws, and we ask that our vendors do the same.
The Omaha Potter Faire has adopted a strict policy regarding bootleg merchandise. Selling merchandise which is inspired by or which parodies copyrighted works is perfectly acceptable; selling infringing merchandise is illegal and subjects both vendors and our organization to civil liability. Vendors selling some bootleg merchandise among their wares will be asked to remove it from display. We understand that the distinction can be difficult to make, and some unlicensed merchandise may accidentally slip into a legitimate display. Flagrant bootlegging (defined loosely as a vendor whose merchandise consists largely or wholly of infringing merchandise), or refusal to remove infringing merchandise, will result in vendor removal, without refund, at the sole discretion of the organizers of the Omaha Potter Faire.
If your business offers for sale any merchandise with words such as “Harry Potter,” “Hogwarts,” “Voldemort,” or is called “Time Turner,” “Elder Wand,” etc., please ensure that your products bear the appropriate copyright language to indicate it is produced under license. Vendors are responsible for ensuring the legality of their merchandise.
